Preamble
These terms of use (hereinafter the “Terms”) are entered into between:
- SCOQI, publisher of the QALITEL logigramme online software, hereinafter referred to as “the Publisher”;
- any person accessing the service and its features, hereinafter referred to as “the User”.
Accessing and using the service constitute full and unreserved acceptance of these Terms.
1. Principles
The purpose of these Terms is to provide the legal framework for the use of the QALITEL logigramme online software and its associated services, available at https://www.logigramme.io.

2. Amendment and term of the Terms
These Terms are entered into for an indefinite term and take effect with respect to the User from the moment use of the service begins.
The Publisher reserves the right to amend these Terms at any time. The applicable version is the one in force on the date the service is used; any substantial change is brought to the User’s attention by publication of the new version and, where applicable, by email.
3. Access to the service
Any User with Internet access may use the QALITEL logigramme online software. The costs of access (Internet connection, computer equipment, etc.) remain the User’s responsibility.
The service includes free features as well as an area reserved for registered users, accessible using their login credentials.
The service may be interrupted or suspended, in particular for maintenance, without the Publisher being required to give prior notice. The Publisher nevertheless endeavours to ensure the continuity and availability of the service.
4. Liability and User contributions
The Publisher may not be held liable in the event of any failure, breakdown, difficulty or interruption of operation preventing access to the service or to one of its features.
The connection equipment is the sole responsibility of the User, who must take all appropriate measures to protect their equipment and data, in particular against malicious software.
The User may publish on the service the flowcharts they create using QALITEL logigramme. They undertake to remain respectful of others and compliant with the law, and accept that their publications may be moderated or refused by the Publisher.
By publishing on the service, the User grants the Publisher, on a non-exclusive and free-of-charge basis, the right to represent, reproduce, adapt and distribute their publication solely for the purposes of operating and promoting the service. The Publisher undertakes to credit the author when using their publication.
5. Intellectual property
All elements of the service (texts, logos, drawings, videos, interfaces, code, etc.) are protected by the French Intellectual Property Code and remain the property of the Publisher or its partners.
The documents and creations produced by the User using QALITEL logigramme remain their property; they are solely responsible for them. The User shall refrain from any use likely to infringe the Publisher’s intellectual property rights.
6. Protection of personal data
The Publisher processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (“Informatique et Libertés”). The data controller is SCOQI (scoqi@scoqi.com).
Data collected
- Account creation: surname, first name, email address, telephone number, postal address, company;
- Login and use: credentials, connection, usage and technical location data;
- Payment: bank details are entered and processed directly by the payment provider PayPal; they are neither collected nor stored by SCOQI;
- Communication: when the service is used to communicate with other members, communication data is stored temporarily.
Purposes and legal bases
- Provision, operation and improvement of the service — performance of the contract;
- Management of payments and invoicing — performance of the contract and legal obligation;
- Security, prevention and detection of fraud and incidents — legitimate interest;
- User support and management of any disputes — legitimate interest;
- Sending commercial information — only with the User’s prior consent, which may be withdrawn at any time.
SCOQI carries out no advertising profiling and displays no targeted advertising based on browsing history.
Retention periods
- Account data: for the entire duration of the contractual relationship, then for up to 3 years from the last contact for prospecting purposes; deleted or anonymised thereafter;
- Invoicing data: 10 years, in accordance with accounting obligations (art. L123-22 of the French Commercial Code);
- Connection data: 12 months, in accordance with applicable regulations;
- Cookies: lifespan not exceeding 13 months (see article 7).
Sharing data with third parties
Data is never sold. It may be shared with providers strictly necessary to the service:
- PayPal, for payment processing. As PayPal may process data in the United States, these transfers outside the European Union are governed by the appropriate safeguards provided for by the GDPR (Standard Contractual Clauses of the European Commission);
- the service’s host, for its technical operation;
- administrative or judicial authorities, where required by law.
Security
The Publisher implements appropriate technical and organisational measures to protect data against any alteration, destruction or unauthorised access. As the Internet is not a completely secure environment, absolute security cannot however be guaranteed.
User rights
In accordance with the GDPR, the User has the rights of access, rectification, erasure, restriction, objection and portability of their data, as well as the right to withdraw consent at any time. These rights may be exercised by contacting scoqi@scoqi.com; proof of identity may be requested.
The User also has the right to lodge a complaint with the French Data Protection Authority (CNIL — 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr).
7. Cookies
The service uses cookies strictly necessary for its operation (login session, language preference, cart); these are exempt from consent.
Audience measurement cookies may be placed only after obtaining the User’s consent, which they may refuse or withdraw at any time. The service uses no advertising cookies. The User may also configure their browser to manage or disable cookies.
8. Governing law and jurisdiction
These Terms are governed by French law. Failing an amicable settlement, any dispute relating to their validity, interpretation or performance falls within the jurisdiction of the French courts.
9. Reference language
These Terms are drawn up in French. They may be translated into other languages for the User’s convenience. In the event of any contradiction or divergence of interpretation between the French version and a translated version, only the French version shall prevail.
